Building Site Description: Our Building Plot sits in an elevated position with commanding views as pictured at the top of this webpage, looking over green fields, river, sandy beach and blue sea. We are advised by a professional chartered surveyor that the site size is approximately .27 of an acre (0.11 Hectare). This detail is given in good faith with the caveat that prospective buyers should satisfy themselves to the accuracy of measurements. This  plan drawing may also be of help.

The writer of this website actually caught sunstroke in 1999 here at Bettyhill such is the little known secret that the north of the UK is often like the South of France in Summer. The off-season months are often fabulously beautiful as well. The area is famed forsurfing at nearby Thurso, and world class diving is just across the water from our Building plot at Scapa Flow on Orkney – access via Pentland Ferries and/or Northlink Ferries. Our Building Plot also has very good road links to cities such as Inverness, and regular air flights as detailed on our Travel & Connectivity webpage. With regard to this Building Plot for sale, there is current, enduring Outline Planning Permission for the construction of a luxury detached 4 bedroom dwelling.

There was, until September 2013 Full Detailed Planning Permission. Whilst the Outline Planning Permission is still valid, the Full Detailed Planning Permission has since lapsed. Given that a new owner will likely have their own newbuild design ideas, we are selling our Building Plot with Outline Planning Permission. The new owner can either opt for the reactivating this Full Planning Permission as previously granted per the architect drawings above, or submit their own preferred design for the Full Planning Permission and Building Warrant stage of the build. In the meantime we are able to show the plan drawings of this unique luxury house to be situated on an elevated part of this beautifully located Building Plot.

The title is Feuhold which is the best quality of land title possible in Scotland, and equivalent to Freehold title elsewhere in the UK.

It is also important to note that a buyer is NOT obliged to build the particular design for which FULL PLANNING PERMISSION was previously granted and as illustrated above.

ENDURING OUTLINE PLANNING PERMISSION

PLEASE NOTE: The current and Outline Planning Permission for our Building Plot is “ENDURING” – that the Outline Planning Permission CANNOT be extinguished. The Local Authority have confirmed that as the statutorily defined “meaningful start” was commenced within the 5 year timeline period stated on this development’s PLANNING PERMISSION and well within the permission date of 19th March 2008, then the OUTLINE PLANNING PERMISSION is what the Local Authority Planning Department define as “ENDURING”.

It is, however, a material specification that when FULL PLANNING PERMISSION and the BUILDING WARRANT element of the process are progressed, the build shall be in the required vernacular for the area, and at a 1.5 storey style of design. This class is illustrated well in the above links and illustrations. It is possible to vary from the general design brief and 1.5 storey guideline, but this will require discussion with the Local Planning Authority as appropriate.

SERVICED SITE

Our Building Plot is being sold as serviced. The BT telephone landline, water and electricity have been run to the plot boundary. The junction boxes are positioned about half way across the front of the plot. Sewage infrastructure is also run across the wholedevelopment and DSC chamber is located within the plot.

This plan is what forms the official Title Deed as now registered at the Scottish Land Registry. Further detail and access to the complete Scottish Land Registry Title Deed from our solicitors. The title is Feuhold [Scottish Freehold equivalent] and is the best quality of title ownership available in Scotland.

If/when you visit the building site please follow the newly constructed access road from Munro Place. This is the road area coloured yellow on the plans of the Local Authority and are those that the original site developer, Mr Jappy purchased and which forms the direct connection from the existing Local Authority “adopted” road, namely Munro Place. This now connects directly to our new site road right up to our FULLY SERVICED Building Plot at Seabreezes. At the time of writing the overall site developer, Mr Jappy had reached sufficient progress with electricity, water, drainage, pavement, street-lighting on the site as to be released from the Local Authority Bond, following from which will shortly be the “adoption” of our site development spur by the Roads Department, and normalisation of use by homeowners, visitors etc., to our Building Plot. Mr Jappy is holding off laying the final tarmacaddam until ALL of the underground services have been completely installed. This is in order to save new and fresh tarmac being dug up again shortly after being finished. The intention being to avoid needless potholes and road surface scarring to the finished development.

The original OUTLINE PLANNING PERMISSION was formally granted on 19th March 2008. For the sake of good form it is important to note key aspects relating to Planning Permissions.

In this case there is wording that the “development to which it relates must be begun not later than the expiration of five years beginning with the date of this permission”.

For the sake of good form, we have now had direct confirmation from the Highland Council Planning Authority Case Officer, Mr Bob Robertson that as a “Material Operation” had begun on the main site well WITHIN the five year period, then in terms of the Town and Country Planning (Scotland) Act 1997, the OUTLINE PLANNING PERMISSION had begun and therefore was now enduring. For the avoidance of doubt, as this project had commenced and been progressed to a sufficient degree – major roadbuilding, pavement construction, street lighting and site full service connection etc – the OUTLINE PLANNING PERMISSION we have on site and including our Building Plot is now “live in perpetuity”.

That means the Planning Permission to build a detached house on our site is permanent and now just awaits the submission of the new owner’s DETAILED plans for that house in order to move to the next stage of this process and obtain a FULL PLANNING PERMISSION and requisite BUILDING WARRANTS to proceed with the actual newbuild.

For the actual statutory legislation on the “Meaningful Start” element which secures an enduring OUTLINE PLANNING PERMISSION, please be guided to:

It is also worth reminding possible buyers of our Building Plot that there was previously a FULL PLANNING PERMISSION for this site…

These lapsed around September 2013 and are NO LONGER live on a FUll basis [though OUTLINE Planning Permission is still alive]. But an application to reinstate this detailed and FULL PLANNING PERMISSION can be made if a new buyer wishes to reinstate this design. The original architects – Knight & McDonald – have been very kind and helpful. They are more than happy to resubmit the drawings and FULL PLANNING PERMISSION paperwork for a new owner to the Highland Council if the new owner would like the house as originally designed for the plot to be the actual newbuild for this site.

Though of course, a new owner may wish to have their own dedicated house design submitted for the FULL and DETAILED part of this process.

The detailed plan specifies what is know as a 1.5 storey house style to fit in with the local vernacular. Examples of this 1.5 storey style appear courtesy of a local housebuilder – Roy Homes Ltd. This housebuilder has experience of over 1,000 newbuild homes and is well regarded in the area.
